Terms & Conditions

This agreement applies when you order food or drink (“Items”), via our websites *.plate.click or mobile application (“Applications”), to be delivered to your table at a venue that partners with PLATE (“Partner”). Please read these Terms in detail before placing an order via our Applications. If you have any questions about these terms, contact us at hello@plate-uk.com before placing an order. As a consumer, you have certain legal rights when you order Items via our Sites. You can find more information at: https://www.citizensadvice.org.uk/consumer/. The below Terms apply in addition to your legal consumer rights. By setting up a PLATE account, you confirm that you consent to these Terms. 1. Information About Us www.plate.click is operated by PLATE.CLICK Ltd, a company incorporated and registered in England and Wales. Our company registration number is 12884532 and our registered office address is Cavendish Mansions, Clerkenwell Road, London, United Kingdom, EC1R 5DQ. You can contact us at hello@plate-uk.com. 2. Purpose of This Agreement Our solution connects you with pubs, bars, cafés, hotels and other hospitality merchants that we partner with (“Partners”) and allows you to order food or drink (our “Service”). When you order, our platform facilitates the ordering process via our Applications. Once you have placed an order, the Partner will deliver it to the table using the information specified upon ordering. Whilst we provide the ordering platform, it is the Partner’s obligation to deliver the order to your table. In the event of any issue with your order or payment, please contact the Partner in question. The laws governing your purchase are the same as when purchasing the items directly from the Partner. To the fullest extent permitted by law, we do not have any liability to you in relation to your purchases from a Partner, or in relation to the services provided by any payment provider. 3. Your Account Before you can place an order using our Applications, you must create a PLATE account. When opening an account, you may be required to set a password, or use another secure log-in method such as authenticating via Google. You may also have to provide your debit or credit card details. You must keep any sensitive data pertaining to your PLATE interactions, including your password, secure in order to prevent unauthorised access to your PLATE account. If someone other than yourself gains access to your account, you will be responsible to pay for any orders made by them and we and our Partners cannot be held accountable for any monetary losses you may suffer, unless the person using your account obtained access due to a flaw in our Applications. You may close your PLATE account at any time by contacting us at hello@plate-uk.com. We may suspend access to your account, or close it permanently, if we have reason to suspect that your account has been used by an unauthorised party. We may also close your account in the event of service abuse. This includes but is not limited to: applying for refunds or credit to which we do not consider you are entitled to, making repeated, unreasonable complaints, or mistreating our staff or those of our Partners. 4. Service Availability Each Partner has a dedicated page (“Partner Page”) in our platform, from which you can place orders. You must ensure that you are physically in the Partner’s premises before placing an order. Further, it is your responsibility to provide the correct table number, given name and surname so that the Partner knows where to deliver your order. Our Partners declare their operating hours which we display on the Partner’s page. You will not be able to order outside of the Partner’s operating hours. In the event you try to do so, the system will notify you that ordering is not possible as the Partner is currently closed. 5. Ordering When you place an order, it must be reviewed and accepted by our Application as well as the Partner. Your order may, from time to time, be rejected if, for example, the items you have ordered are temporarily unavailable. When an order is rejected, the Partner will notify you. When your order is approved by the Partner, you will be notified by our Application. This agreement for the supply of Service comes into existence once your order has been accepted and we have notified you. You are responsible for paying for your order using your PLATE account and complying with these Terms, even when you order items on behalf of someone other than yourself. Some Partners may apply a minimum order spend amount. All items listed on the Partner Page are subject to availability. Partners may use nuts or allergens in the preparation of certain Items. Partners can specify allergen information pertaining to given menu items. That information may be displayed next to the item in question. If you have an allergy and no information is available or you have further questions, please speak with the Partner before placing the order. PLATE cannot guarantee that the Items offered by our Partners are free of allergens. 6. Ordering to the Table When you place an order, our Application will send your name and table number to the Partner. You can make use of PLATE’s table QR codes (“Table Code”) which contain the Partner name and table number. When scanning a Table Code, you will be navigated to the Partner Page. On the “My Orders” page, our Application will display your table number as obtained from the Table Code. It is your responsibility to verify the table number is correct before submitting the order. If it is incorrect or in the event you moved to a different table, you should update the table number on the “My Orders” page, prior to placing the order. You may also order without scanning a Table Code by manually navigating to the Partner Page in our Application, in that case, you must enter your table number on the “My Orders” page. When your order is accepted by the Partner, you will be notified by the Application. The Partner will then update the order status as it is being processed. You should be seated at the table when your order arrives. In the event you are not at the table when your order arrives, you will still be charged. Our Partners do their best to deliver the order to you in a timely fashion but there may be times when your order is delayed. If you wish to make a complaint, contact the Partner directly while at their venue. 7. Your Rights in Case Something is Wrong with Your Item You have the legal right to receive goods which comply with their description, are of satisfactory quality and comply with any specific requirements you informed the Partner of and to which the Partner agreed before approving your order. If you feel that the Items you have received do not comply with the above, please contact the Partner whilst at their venue. 8. Age Restrictions There are Items listed on our Partners’ Page for which age restriction applies and can only be sold to persons aged 18 or over. By placing an order for an age restricted product, you confirm that you are at least 18 years old. PLATE operates an age verification policy whereby customers ordering age restricted products may be asked by the Partner to provide proof that they are of the required age. The Partner may refuse to sell age restricted products to any person until they present a valid photo ID proving they adhere to the age restriction. The Partner may also refuse to sell age restricted products to any person who is, or appears to be, under the influence of alcohol or drugs. If the order of any age restricted product is denied, the Partner may, under its own discretion, process a refund to the card used when placing the order. 9. Cancellation Once you have submitted your order via PLATE’s Application it cannot be cancelled. If you have any requests with regards to your order after its submission, please contact the Partner directly whilst in the venue. The Partner, at their own discretion, may cancel the order and process a refund to the card from which you paid for your order. This is by no means guaranteed. 10. Prices, Payments and Promotions Item prices on the Partner Page include VAT. By opening a PLATE account, you confirm that you are using our Services for personal, non-commercial use. Partners may operate dynamic pricing which means the price of items may change. PLATE may charge you a service fee up to 10% in addition to your order value. You will be notified of any service fees and tax charges before you make a payment using our Applications. No changes in item price or service fees will be applied to already confirmed orders, unless there is an obvious pricing mistake, nor will additional changes be applied to Items already listed in the “My Order” page, provided that you submit the order within 1 hour of creating it. In the event of a pricing mistake, the Partner may cancel the order; in which case, you will be notified by the Partner. The total price of your order will be shown on the “My Order” page, as well as the price of each individual Item ordered, and applicable service fees. Payment for your order can be made using a credit or debit card, or any other payment method made available by PLATE. Once your order has been confirmed by the Partner, your credit or debit will be validated, and the total amount marked for payment. Payment is made directly to our Partner. All refund requests must be made directly to the Partner, preferably whilst you are at the Partner’s premises. Partners may push promotions through our Applications. These are displayed as you are using the Application or are sent as a notification to your mobile device. These promotions are fully controlled and managed by the Partner. The Partner may choose to withdraw the promotion at any time, unless you have already placed an order based on the promotion and have received an order confirmation. 11. Losses and Damages We are responsible to you for any loss or damage you suffer that is a foreseeable result of us breaching these Terms or failing to use reasonable care and skill in relation to your use of our Service. We are not responsible for any loss or damage that could not have been foreseen and avoided. Loss or damage is “foreseeable” if its occurrence is inevitable or if you informed us that it might occur prior to placing an order. We exclude and limit our responsibility to you for loss or damage to the fullest extent save where it would be unlawful to do so. Subject to this, we are not responsible for any loss or damage that you suffer as a result of your own breach of these Terms or as a result of any IT hardware or software failure other than a failure in our Applications. 12. Your Privacy Under data protection legislation, we are required to provide you with information about who we are, the personal data we collect from you, and how we use it. This information is provided in our Privacy Policy. It is important that you read this information. 13. Other Terms If either we or you have any right to enforce these Terms against the other, that right will not be lost even in the event some time has passed without exercising said right. Or waive their right to enforce it in any instance. If a court or other authority decides that any part of these Terms is illegal or ineffective, the rest of the terms will be unaffected and remain in force. We may change these Terms from time to time. If we make any changes which affect your rights in relation to our Service, you will be notified. Changes to the Terms will not affect any confirmed orders placed prior to making the change. These Terms are governed by English law and you can bring legal proceedings in respect to our Applications in the English courts. 14. License Restrictions You agree: - Not to rent, lease, sub-license, loan, provide or otherwise make available, our Applications or Services in any form, in whole or in part to any persons; - Not to translate, merge, adapt, vary, alter or modify, the whole or any part of our Applications, documentation or Service; - Not to disassemble, decompile, reverse engineer or create derivative works based on the whole or part of our Applications nor attempt to take any of the above actions; - To comply with all applicable technical control or export laws and regulations that apply to the technology used or supported by our Applications. 15. Acceptable Use You may use our Applications and Services only in a lawful manner. You must: • Not use our Applications or Services in any way that breaches applicable law or regulation. • Not infringe our intellectual property rights or those of any third party in relation to your use of our Applications. • Not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of our Applications. • Not use our Applications in a way that could damage, disable, overburden, impair or compromise our platform or security, or interfere with other users. • Not collect or harvest information or data from any Service or our Applications or attempt to decipher any transmissions to or from the servers running any of our Services. 16. Intellectual Property Rights We are the owner of, or the licensee of (in case of third-party technology) all intellectual property rights in our Applications and our Service, and in the material published on these. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content on our Applications in any way expect for your own personal, non-commercial use. 17. Communications By agreeing to these Terms you consent to receiving marketing communications from PLATE and our Partners. You can opt in or out of these communications at any time using the unsubscribe link placed at the bottom of all promotional emails. Essential communications from PLATE or our Partners (for example, pertaining to the status of your order), will be sent regardless of your marketing preferences.
